About claims
If you have experienced alleged damage or injury in connection with highways, you may be able to make an insurance claim. Highways are roads, pavements, or public rights of way.
There are 3 types of highways insurance claims:
- vehicle damage
- property damage
- personal injury
To make a highways insurance claim, you must prove that we (Croydon Council) were at fault by law. You are not automatically entitled to compensation. Each claim will be investigated and assessed individually.
We will defend claims if there is:
- no legal responsibility on our part
- a defence under Section 58 of the Highways Act
Claims against other companies
Your claim may not be against us if the alleged damage or injury occurred because of:
- works carried out by a utility company or contractor
- equipment used that does not belong to us
If so, your claim may be against the responsible company. You will be informed if this is the case.
